Official Rules
SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE CONTINENTAL UNITED STATES WHO ARE AT LEAST 18 YEARS OF AGE AT THE TIME OF ENTRY. NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. SWEEPSTAKES IS SPONSORED BY ARBORMASTER TRAINING, INC ("SPONSOR").
These Official Rules ("Official Rules") govern your participation in the 2008 ArborMaster Sweepstakes. Please read them carefully.
1. How To Enter: Entries will be accepted starting at 12:00am EDT on July 27, 2008. Promotion ends 11:59pm EDT, November 30, 2008. There are two (2) ways to enter: A) visit www.ArborMaster.com, and complete and submit the online registration form in its entirety; B) print your name, complete address, daytime phone number, email address and the words "2008 ArborMaster Sweepstakes" on a 3" x 5" index card and mail to ArborMaster 2008 Sweepstakes, P.O. Box 62, Willington, CT 06279 in a properly stamped envelope. All entries must be received by 11:59pm, November 30, 2008. *Limit: one entry per person, regardless of means of entry. All entries become the property of Sponsor, and will not be returned. All federal, state and local laws and regulations apply.
2. Eligibility: Entrants must be legal residents of the continental United States, at least 18 years of age at the time of entry and must hold a valid driver's license at time of entry (except where prohibited by law). Employees of Sponsor and their immediate families and household members and all other entities or individuals associated with the development, administration, or fulfillment of this promotion (collectively, "Sponsor, et al.") are not eligible to enter. Entries that are lost, late, illegible, incomplete, or incompatible, will not be eligible.
3. Major Prize Drawings: The names of all potential Grand Prize, Second Prize and Third Prize Winners ("Winners") of the prize packages will be selected on or about December 15, 2008, in a random drawing from among all eligible entries received. All Winners will be notified by mail and/or email within approximately five (5) days of drawing and may be required to execute (without limitation) tax acknowledgement fomrs, affidavits of eligibility, liability releases, indemnification agreements, and publicity releases (except where prohibited by law) within ten (10) days of date of mailing of notification by Sponsor or the applicable Prize will be forfeited and awarded to another Winner from remaining eligible entries by means of a random drawing (at Sponsor's sole discretion). All Prizes will be awarded.
4. Prize Descriptions/Odds of Winning: The prizes are particularily described below:
Prize Packages
One (1) Grand Prize: One (1) Grand Prize will be awarded nationally from all eligible entries. Prize package includes 3 nights stay at the Inn on Biltmore Estate based on ROH double occupancy, two (2) length of stay daytime admission tickets, Land Rover 2 hour driving experience, full day bike rentals for two (2), one (1) hour guided horseback ride for two (2). In addition, one (1) 2-day ArborMaster training module for one (1) person at any ArborMaster regional Open Enrollment location (pre-requisites will apply), one (1) Husqvarna 346 XP Chainsaw saw including PPE (hard hat system, eye protection and chainsaw chaps), one (1) 150' ArborMaster Climbing Line with eye splice, one (1) Vermeer Arborwear Jacket and Arborwear Pants, one (1) $100 gift certificate from SherrillTree, one (1) $100 gift certificate from Buckingham Mfg. (est. value: $3690.00). Prize package does not include air or gound transportation, meals or local taxes and service charges. Prize package must be redeemed and used/completed by October 30, 2009. Accommodations and outdoor activites at the Biltmore Estate require advance reservations and are based on availability at the time of request. Black-out periods at the Inn at Biltmore Estate: December 22, 2008 - January 1, 2009 and November 24-28, 2009. Sponsor cannot guarantee availability. Eligibility to redeem the ArborMaster module requires full time employment working in the green industry as an arborist, in a hands-on role supporting an arborist or other related role in which you use arborist equipment on a regular basis. If the winner does not meet the eligibiltiy requirements to redeem this module, Sponsor will provide a prize of Sponsors choice of equal value.
One (1) Second Prize: One (1) Second Prize will be awarded nationally from all eligible entries. ISA/ArborMaster DVD Educational series: ArborMaster Climbing Techniques; ArborMaster Chainsaw Safety, Maintenance and Cutting Techniques; The Art & Science of Practical Rigging; Arborists' Knots for Climbing & Rigging. Plus two (2) $25 gift certificates from SherrillTree and a Vermeer windbreaker (est. value: $739.00)
Ten (10) Third Prizes: Ten (10) Third Prizes will be awarded nationally from all eligible entries. ArborMaster logo items to include a hat, tee shirt and Camelbak water bottle (est. value: $35.00 each)
The actual value of prizes may be less than the estimates provided. Prizes in all categories are not transferrable or substitutable by winners. Sponsor may substitute prizes of equal of greater value for stated prizes. Prizes are not redeemable for cash. Winners are responsible for all federal, state and local taxes and all other costs and expenses not specifically stated above, including but not limited to travel and meals, registration, license, title, insurance fees, the cost of any upgrades, optional equipment, and changes made to the 2008 ArborMaster Sweepstakes (equipment/tools/prizes) after the award of the Prize. Sponsor may, it its sole discretion, require Winners to sign a further indemnifcation agreement. Winners must present appropriate proof of eligibility as described in paragraph two ("Eligibility") with a valid driver's license (except where prohibited by law), or the applicable Prize will be forfeited and awarded to potential winner in a random drawing (at Sponsor's sole discretion) from remaining eligible entries.
The odds of winning each prize depend on the total number of eligible entries received by aone of the aforementioned approved means of entry.
5. Internet: All entries must be received by 11:59pm EDT, November 30, 2008. Sponsor is not responsible for intterrupted or unavailable network server or other connections, miscommunications, failed or faulty telephone or computer transmissions or jumbled, scrambled, or misdirected entries or transmissions; phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties; other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the promotion or for illegible, unintelligible, late, lost or stolen entries or entries that cannot for whatever reason be downloaded or incorrect or inaccuate entry information, whether cuase by Internet users or by any of the equiopment or programming associated with or utilized in the promotion or by any technical or human errors which may occur in the processing of any entries in this promotion. Persons found tampering with or abusing any aspect of this promotion, as soley determined by the Sponsor, will be disqualified and may be subject to prosecution. If in the sole judgement of the Sponsor, the promotion is compromised by virus, bugs, unauthorized human intervention, terrorism, acts of God, sabotage or other causes beyond the control of Sponsor, which corrupts the adminstration, security, fairness or proper play of the promotion, Sponsor reserves the right, in its sole discretion, to discontinue, amend, modify, suspend or teminate the promotion and conduct the random drawing to select potential winners from among all eligible entries received as of the date of its termination or the promotion. Any personally identifiable information collected during your participation in this promotion will be collected by Sponsor and used by Sponsor and its agents for purposes of the proper administration and fulfillment of the promotion as described in these Official Rules. This information may also be used by Sponsor for promotional and marketing activity purposes and will not be shared with any third party except as required by law. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITMATE OPERATION OF THIS PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
6. General: Void where prohibted by law. By entering this promotion, entrants agree to abide by these Official Rules. All federal, state and local laws and regulations apply. Winners agree that their acceptance of a prize constitutes consent to the use by Sponsor of their names, photographs, likenesses and/or statements for advertising and pubilicity purposes in any media as Sponsor and its agents so determine without further compensation or notice, except where prohibited by law. Any entries or other materials that are incomplete, illegible, altered, counterfeited or tampered with or obtained other than through legitmate and authorized sources are void and Sponsor (and all other entities and individuals associated with this promotion) shall not be responsible for illegible, damaged, lost, late, stolen, postage due, incomplete, undelivered/undeliverable or misdirected mail/entries. Mechanical reproductions or facsimilies are prohibited. Judges' decisions are final. Proof of an entry will not be deemed to be proof of a receipt by Sponsor. In the event that: (a) any prize notification, or prize, is returned to Sponsor as undeliverable, (b) a sweepstakes Winner fails to comply with the Official Rules, or (c) a sweepstakes Winner refuses his/her prize, the sweepstakes Winner will be disqualified and Sponsor shall select, by means of a random drawing from all remaining eligible entries (at Sponsor's Sole Discretion), an alternate sweepstakes Winner. By participating, each participant and Winner releases and agrees to hold harmless Sponsor and its subsidiaries, affilate companies, parent companies, alliance partners, suppliers, promotional and advertising companies, and all directors, officers, employees, shareholders, representatives and agents of each of them, from any and all liability, and waives all cuases of action relating to any and all injuries, costs, damages, claims and losses of any kind, including (without limitation) any and all claims for consequential and incidental damages, attorney's fees, and/or lost revenue, income or profits arising out of participation in the Sweepstakes or the acceptance, delivery, possession, use and/or enjoyment of the prize(s), including any and all injuries, costs, damages, claims and losses of any kind, relating to death, personal injury or damage to property. Some jurisdictions do not allow the limitation or exclusions of liability for incidental or consquential damages, so the above may not apply to you. All prizes are awarded by Sponsor without any warranties or any kind and are awarded "as is". The laws of the Commonweath of Massachusetts shall govern the interpretation of these Official Rules. Any and all disputes will be resolved in the appropriate courts in the Commonwealth of Massachusetts exclusively, and subject to the laws of the Commonweath of Massachusetts. Should there be a conflict between the laws of the Commonwealth of Massachusetts and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Massachusetts.

Box 62, Willington, CT 06279. Please allow sixty (60) days for removal of your name.
